By accessing or using DeFi Guardian ("the Interface"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Interface. DeFi Guardian is a non-custodial interface that facilitates interactions with various decentralized finance (DeFi) protocols and blockchains.
You must be at least 18 years old to use the Interface. You represent that you are not: (a) located in, organized in, or a resident of any country subject to comprehensive US, EU, or UN sanctions (such as Cuba, Iran, North Korea, Syria, or Russia); or (b) listed on any sanctions list of prohibited or restricted parties (including OFAC's SDN List). We reserve the right to restrict access to the Interface at any time.
Your use of the Interface is subject to our Privacy Policy, which describes how we collect, use, and share your personal information (including wallet addresses, technical telemetry, and contacts for notifications). By using the Interface, you consent to such processing. We retain data only as long as necessary for operational or legal purposes.
You are responsible for your own security and compliance. Specifically, you agree that you:
The Interface, including its "look and feel" (e.g., text, graphics, images, logos, page headers, button icons, and scripts), proprietary content, information and other materials, and all content and other materials contained therein, including, without limitation, the DeFi Guardian logo and all designs, are the proprietary property of DeFi Guardian or our affiliates, licensors, or users, as applicable. You agree not to scrape, copy, or engage in any competitive use of the Interface without express written permission.
DeFi Guardian is effectively a visual interface to the blockchain. We do not have custody, possession, or control of your assets at any time. You understand that:
WARNING: The data presented on the Interface (including health factors, metrics, and prices) and any alerts sent via third-party channels (Telegram, Discord, Email) may be delayed, incorrect, incomplete, or not delivered due to technical failures, network congestion, or third-party service outages.
You explicitly acknowledge that:
By using the Interface, you acknowledge and accept the inherent risks associated with DeFi and blockchain technology. Digital assets are not insured by the FDIC, SIPC, or any other public or private insurer. You bear the sole responsibility for any loss of value or assets.
Vulnerabilities, bugs, or exploits in the various protocols (Aave, Compound, etc.) you interact with.
Extreme price fluctuations that may lead to liquidation of your collateral assets.
Changes in laws and regulations that may impact your ability to use DeFi protocols.
Issues with blockchain networks, congestion, or high gas fees preventing transaction execution.
Certain paid plans include automated liquidation protection features. When enabled, our system may submit on-chain transactions on your behalf using pre-approved smart contracts (e.g., flash loan repayments, collateral swaps). These transactions are irreversible once confirmed on the blockchain. You are solely responsible for configuring automation thresholds and approving router contracts on each chain. DeFi Guardian is not liable for losses resulting from automated execution, including but not limited to: failed transactions, slippage beyond configured limits, smart contract vulnerabilities in third-party protocols, network congestion delays, or incorrect configuration of automation parameters.
The information provided on DeFi Guardian, including health factors, risk metrics, and alerts, is for informational purposes only. It does not constitute financial, investment, or legal advice. You should perform your own due diligence before interacting with any protocol. We do not recommend or endorse any specific protocol, token, or strategy.
The Interface may contain references or links to third-party web sites or services (including standard web links and decentralized applications) that are not owned or controlled by DeFi Guardian. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. Your use of third-party wallets and protocols is governed by their respective terms of service. You are solely responsible for any fees incurred when interacting with third-party protocols.
You agree not to use the Interface for any unlawful purpose, including but not limited to:
Subscription Tier Limits: Each subscription plan is subject to the following usage limits:
Fair Use Policy: To ensure the quality and stability of the Service for all users, plans marketed as "Unlimited" are subject to the soft caps listed above to prevent abuse.
We reserve the right to suspend or terminate your access to the Interface at any time, without notice, for any reason, including but not limited to: (a) violation of these Terms; (b) if we suspect illegal activity; (c) compliance with legal requirements; or (d) sanctioned risks. Upon termination, your right to use the Interface will immediately cease.
You agree to hold harmless, release, defend, and indemnify DeFi Guardian and its officers, directors, employees, contractors, agents, affiliates, and subsidiaries from and against all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your access and use of the Interface; (b) your violation of these Terms; or (c) your violation of the rights of any third party or any applicable law. This indemnification obligation does not apply to DeFi Guardian's own gross negligence or willful misconduct.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEFI GUARDIAN AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE INTERFACE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE INTERFACE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE INTERFACE EXCEED THE GREATER OF one hundred U.S. Dollars ($100.00) OR THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE INCIDENT.
THE INTERFACE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE INTERFACE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials, or technical failures of the blockchain networks on which we rely.
These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands (BVI). Any dispute arising out of or related to these Terms shall be resolved through binding arbitration administered under the rules of the London Court of International Arbitration (LCIA). The seat of arbitration shall be London, UK, and the language shall be English. You agree to waive your right to a trial by jury or to participate in any class action. Nothing in this clause prevents consumers from exercising their statutory rights under applicable local laws.
We may provide any notice to you under these Terms by: (a) sending a message to the email address you provide; or (b) posting to the Interface. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
These Terms constitute the entire agreement between you and DeFi Guardian. We may assign our rights and obligations under these Terms. The following sections survive any termination: Intellectual Property, Data Accuracy and Alerts, Assumption of Risk, Third-Party Content, Indemnification, Limitation of Liability, Disclaimer of Warranties, Governing Law and Arbitration, and General Provisions. If any provision is found to be invalid, the remaining provisions remain in full force.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice (e.g., by updating the date at the top of these Terms or via Interface notification) at least 7 days prior to the effective date. Your continued use of the Interface following the posting of changes constitutes your acceptance of such changes.
